Agreement to Terms

By accessing or using Reachable ("Service," "Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you (whether personally or on behalf of an entity) and Reachable regarding your use of our cold email platform.

Description of Service

Reachable is a cold email platform that provides:

  • Automated email warmup to improve deliverability
  • Campaign management and email sequence automation
  • Lead import and management
  • Unified inbox (Unibox) for managing replies
  • Deliverability analytics and monitoring
  • Multi-account email management
  • Personalization and template variables

Account Registration and Security

Account Creation

To use the Service, you must create an account with accurate and complete information. You must be at least 18 years old to create an account.

Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring your email accounts comply with their respective terms of service

Acceptable Use Policy

Permitted Uses

You may use Reachable for legitimate cold email outreach, including:

  • Business development and lead generation
  • Sales outreach to potential customers
  • Professional networking and partnership building
  • Recruiting and talent acquisition

Prohibited Uses

You agree NOT to use the Service for:

  • Spam: Sending unsolicited bulk emails or violating CAN-SPAM, GDPR, or other anti-spam laws
  • Illegal Content: Promoting illegal activities, products, or services
  • Harmful Content: Phishing, malware distribution, or fraudulent schemes
  • Harassment: Sending threatening, abusive, or harassing messages
  • Purchased Lists: Using scraped, purchased, or non-permission-based email lists
  • Deceptive Practices: Misrepresenting your identity, company, or intent
  • Adult Content: Sending pornographic or sexually explicit material
  • Rate Limits: Attempting to circumvent sending limits or warmup protocols
  • System Abuse: Attempting to hack, reverse engineer, or disrupt the Service

Violation of this policy may result in immediate account suspension or termination without refund.

Compliance with Email Laws

You are solely responsible for ensuring your use of the Service complies with all applicable laws and regulations, including:

  • CAN-SPAM Act (USA): Include accurate sender information, clear subject lines, and unsubscribe mechanisms
  • GDPR (EU): Obtain lawful basis for processing personal data and respect data subject rights
  • CASL (Canada): Obtain consent before sending commercial electronic messages
  • Other Local Laws: Comply with anti-spam laws in recipients' jurisdictions

We provide tools to help you comply (unsubscribe links, personalization), but you are responsible for lawful use.

Subscription and Billing

Pricing Plans

Reachable offers subscription plans with different features and limits:

  • Monthly Plan: $15/month, billed monthly
  • Annual Plan: $150/year, billed annually (17% savings)

All plans include: 100k emails/month, unlimited lead imports, unlimited connected accounts, unlimited warmup, unlimited campaigns, and full analytics.

Payment Terms

  • Subscriptions automatically renew unless canceled
  • Payment is processed at the beginning of each billing cycle
  • All fees are non-refundable except as required by law
  • We reserve the right to change pricing with 30 days notice
  • Failed payments may result in service suspension

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access until that date, but no refund will be issued for partial periods.

Email Account Connections

When you connect email accounts to Reachable:

  • You grant us permission to send emails on your behalf through OAuth
  • You remain responsible for the content of emails sent
  • You must comply with your email provider's terms of service (Gmail, etc.)
  • We are not responsible if your email provider suspends your account
  • You can revoke access at any time through your account settings or your email provider's security settings

Intellectual Property

Our IP

The Service, including all software, designs, text, graphics, and other content, is owned by Reachable and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

Your Content

You retain ownership of content you create (email templates, lead lists, campaigns). By using the Service, you grant us a license to store, process, and display your content solely to provide the Service.

Service Availability and Modifications

We strive to provide reliable service but do not guarantee 100% uptime. We reserve the right to:

  • Modify, suspend, or discontinue features with or without notice
  • Perform scheduled maintenance with advance notice when possible
  • Update sending limits, warmup algorithms, or other technical parameters
  • Impose usage limits to ensure fair use and platform stability

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING:

  • Merchantability, fitness for a particular purpose, and non-infringement
  • Uninterrupted, error-free, or secure operation
  • Guaranteed email delivery rates or inbox placement
  • Compatibility with all email providers or systems

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REACHABLE SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Lost profits, revenue, data, or business opportunities
  • Suspension or termination of your email accounts by third-party providers
  • Deliverability issues, spam complaints, or blacklisting
  • Actions taken by recipients of your emails

Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Reachable, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Content of emails you send through the Service
  • Your email practices or marketing activities

Account Termination

By You

You may delete your account at any time through account settings. Upon deletion, your data will be removed within 30 days.

By Us

We may suspend or terminate your account immediately if:

  • You violate these Terms or our Acceptable Use Policy
  • Your account is used for illegal or harmful activities
  • Payment fails and remains unresolved
  • We receive excessive spam complaints about your emails
  • Continuing to provide service would create legal or security risks

Termination for violations does not entitle you to a refund.

Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or in-app notice. Your continued use after changes are posted constitutes acceptance. If you disagree with changes, you must stop using the Service.

Governing Law and Disputes

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and Reachable
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect
  • No Waiver: Our failure to enforce any right does not waive that right
  • Assignment: You may not assign these Terms; we may assign them without notice
  • Force Majeure: We are not liable for delays caused by circumstances beyond our control
